DA: Officer Justified In Fatal January East Charlotte Shooting
CHARLOTTE, NC — The District Attorney announced Friday that a fatal shooting involving an undercover CMPD detective was justified.

The incident happened on January 26th on Albemarle Road. Officials say the undercover detective started following Josue Diaz and calling for help after Diaz side-swiped his unmarked police SUV.
When Diaz finally came to an abrupt stop, police say he got out and fired at the detective. The undercover detective returned fire and hit Diaz six times, according to the Medical report.
The Medical Examiner also said Diaz had cocaine in his system at the time of the shooting.
CMPD says they recovered a .22 caliber revolver at the scene, which matched a bullet hole in the detective’s SUV. Because Diaz was believed to be affiliated with gang members, the detective’s name is not being released.
